1. Your agreement
When you book, you enter into a contract with Moo Music Uttoxeter, independently run by Olivia Flavell. The booking summary, price, session details and these terms form that contract. The adult making the booking must be at least 18 and have authority to book for every child included.
2. Bookings and payment
A place is confirmed only when payment has been accepted and a confirmation has been issued. Prices and any regular-customer, trial or monthly-booking discounts are shown before payment. You are responsible for checking the class, child age range, venue, date and time before paying.
Card payments are processed securely by the payment provider. Moo Music Uttoxeter does not receive or store full card details.
3. Fixed bookings, non-attendance and refunds
- Every booking reserves a limited place for the named child on the selected date or dates. Customers cannot cancel or transfer a booking through the website.
- If you change your mind, cannot attend or miss a class, the booking remains in place and no automatic refund, credit, transfer or make-up class is provided. This applies to pay-as-you-go, three-week trial and monthly bookings.
- If you tell Olivia that you cannot attend and the reserved place is then resold or the resulting loss is otherwise reduced, any amount retained will be limited to Moo Music Uttoxeter’s reasonable direct loss and unavoidable transaction costs.
- If Olivia cancels a session, you will be offered a suitable replacement, credit or refund for the affected session. If the booked service cannot be supplied, any refund required by law will be provided.
Scheduled leisure activities provided on a specific date do not generally carry the usual 14-day online cancellation right. Nothing in this section removes any statutory right or remedy, including where a service is not provided with reasonable care and skill, is materially different from what was agreed, or is not supplied.
4. Safety and supervision
Classes are participatory activities, not childcare. A responsible parent or carer must remain present, actively supervise their child and follow reasonable safety instructions throughout. Equipment, props and instruments must be used only as directed and must not be left with a child who may use them unsafely.
Please tell Olivia before class about any accessibility needs, allergies, medical matters or other information reasonably needed to adapt the session safely. Do not attend if you or your child has a contagious illness or is too unwell to participate. In an emergency, Olivia may contact the emergency services and take reasonable steps to protect those present.
5. Participation and liability
Music, movement and sensory play involve ordinary everyday risks such as slips, bumps or contact with props. By attending, you acknowledge those inherent minor risks and accept responsibility for supervising your child, following instructions and deciding whether an activity is suitable for them.
Nothing in these terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or restricted.
Subject to that protection, Moo Music Uttoxeter is not responsible for loss or damage that was not reasonably foreseeable, was not caused by a breach of these terms or negligence, relates to business use, or concerns personal belongings brought to a venue. Agreeing to these terms does not mean that you accept risks created by Olivia’s negligence.
6. Behaviour and venues
Everyone must treat children, families, staff and venue users respectfully. Olivia may pause an activity or ask someone to leave where behaviour creates a safety risk or seriously disrupts the group. Venue rules, arrival instructions and access restrictions must be followed. Please keep valuables with you.
7. Photos, recordings and intellectual property
No child will be photographed or used in promotional material by Moo Music Uttoxeter without separate, specific permission from their parent, guardian or another person authorised to give it. If optional permission is given during booking, it applies only to the website and official social-media use described beside the consent switch and can be withdrawn for future use at any time by contacting Olivia. Families must not photograph or record other children without permission. Moo Music songs, recordings, characters, materials and session plans remain protected intellectual property and may not be copied, shared or commercially reused.
8. Events outside reasonable control
A session may need to change because of venue closure, severe weather, illness, emergency, public authority action or another event outside reasonable control. Olivia will give as much notice as reasonably possible and offer an appropriate replacement, credit or refund for a cancelled session.
9. Complaints, changes and law
Please contact Olivia first so that any concern can be investigated promptly. These terms may be updated for future bookings; the version accepted when you book will apply to that booking. These terms are governed by the law of England and Wales, and consumers retain the right to use the courts that apply to them.
